General rental conditions

Scope

These general rental conditions apply to all reservations, offers, and agreements relating to all accommodations and facilities rented or organized by Casa Bohemian Curaçao B.V.

In these general rental conditions, “renter” means the person or persons who enter into an agreement with Casa Bohemian Curaçao B.V. regarding the rental and/or use of the accommodation and/or other facility, as well as all co-users who are part of the tenant’s group and who jointly use the accommodation.

“Landlord” means Casa Bohemian Curaçao B.V. (hereinafter also referred to as Casa Bohemian), registered with the Chamber of Commerce under number 169172. The crib number of Casa Bohemian Curaçao B.V. is 102723321.

Reservations and Cancellations

Casa Bohemian uses a booking system. When the tenant books through the Casa Bohemian website, they pay a USD 100. After this payment, the reservation is final. The tenant can cancel up to 30 days before arrival. The USD 100 will then be used for administrative costs and is non-refundable. Approximately 35 days before arrival, the tenant will receive a payment request for the remaining balance. This payment must be made no later than 30 days before arrival.

If the tenant books a stay within 30 days of arrival, the tenant must pay the full amount at once.

The final cleaning fee is USD 75 and is mandatory. The booking system automatically adds this fee to your reservation.

The tenant pays a USD 300 deposit. This can be paid in cash. In this case, you will also receive the deposit in cash. Casa Bohemian can also authorize the tenant’s credit card. This authorization process works differently than in other countries. Pre-authorization is not possible in Curaçao. With a pre-authorization, the reservation can be immediately removed upon departure. This isn’t possible with an authorization. This means the authorization remains active for a certain period. The timeframe for this varies by bank. On average, it takes about 14 to 30 days.

The tenant can book up to 30 nights at Casa Bohemian through the booking system. If the tenant wishes to stay longer, they can submit a request to Casa Bohemian by email.

If the tenant cancels within 30 days of arrival, the entire amount remains due. If the tenant fails to do so and the payment term has passed, the reservation will automatically be cancelled and considered a cancellation. In that case, the tenant will no longer have any rights under the reservation.

If, after the rental agreement has been concluded, the tenant wishes to make changes to the agreement, the landlord is not obligated to accept these changes. If the landlord accepts your changes, the landlord may charge amendment fees and other additional costs.

If the tenant fails to arrive within 24 hours of the agreed arrival date without further notice, this will be considered a cancellation. In this case, no refund of the rental amount or any portion thereof will be made.

Arrival and Departure

The rented accommodation can be occupied on the agreed arrival date between 4:00 PM and 9:00 PM. If, due to unforeseen circumstances (e.g., a late flight arrival or flight delay), the tenant expects to arrive later than 9:00 PM, the landlord may make an exception. The tenant must notify the landlord in a timely manner.

On the agreed departure date, the accommodation must be vacated by 11:00 AM. The tenant may use the Casa Bohemian facilities on the day of departure. Late check-out is possible, if available and requested in advance. There is an additional charge of USD 50 for late check-outs. The late check-out time is 4:00 PM.

If the use of the accommodation and/or other facilities is terminated earlier than the agreed date, the tenant is not entitled to a refund of (part of) the rental price and/or costs.

Regulations

Smoking is prohibited in the broadest sense of the word.

The tenant must leave the accommodation spotlessly clean. Dishes must be washed and garbage must be placed in the outside bins.

If the tenant misbehaves or causes a nuisance, the landlord reserves the right to immediately remove this person or persons from the resort, without any refund of the rental fee or any part thereof.

Pets are not allowed.

Other than for the number of people for which the landlord has confirmed the reservation, it is not permitted to host or allow third parties to stay overnight at Casa Bohemian without the landlord’s express permission.

The tenant is liable for damage due to breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be reported immediately to the landlord and compensated immediately on-site. In such cases, the damage will be deducted from the deposit. If the amount of damage exceeds USD 300, the renter will have to pay the remaining amount on site.

Force Majeure and Changes

In the event that the landlord is (temporarily) unable to perform the agreement in whole or in part due to force majeure, the landlord will submit a proposed change (for a different period, different accommodation, in the form of a voucher) within 25 days after the tenant becomes aware of the inability to perform the agreement. Force majeure on the landlord’s part refers to circumstances beyond the landlord’s control, including the threat of war, strikes, blockades, fire, floods, natural disasters, pandemics, and/or other disruptions or events, if the landlord is prevented from performing the agreement in whole or in part, temporarily or permanently.

The tenant has the right to reject the proposed change. If you reject the proposed change, you must notify the landlord within 10 days of submitting the proposed change. In that case, the landlord has the right to terminate the agreement with immediate effect. In the event of force majeure, the landlord will refund any monies paid to the tenant, minus an administration fee of USD 100.

Liability

The landlord accepts no liability for theft, loss, or damage of or to property or persons, of any nature whatsoever, during or as a result of the stay at Casa Bohemian and/or the rental/use of the accommodation/other facilities.

Liability for damages consisting of loss of enjoyment of the trip or business or other consequential damages is excluded under all circumstances. The landlord is in no way liable for damages for which a claim for compensation exists under travel and/or cancellation insurance or any other insurance. The landlord is not liable for disruptions to the service or defects in services provided by third parties.

The tenant is jointly and severally liable for all loss and/or damage to the rented accommodation and/or the tenant’s property, which occurs during the tenant’s use thereof, regardless of whether this is the result of the actions or omissions of the tenant or of third parties present at Casa Bohemian with the tenant’s permission. In case of improper use or failure to leave the accommodation or inventory in a proper condition, including but not limited to excessive soiling, additional costs will be charged, which the tenant is obliged to pay immediately.

Applicable law

The agreement between the tenant and the landlord is governed exclusively by Dutch/Curaçao law.
