General
These general rental conditions apply to all reservations, oDers, and agreements relating to all accommodations and facilities rented or organized by Casa Bohemian Curaçao B.V.
In deze algemene huurvoorwaarden wordt onder “huurder” verstaan: de persoon of personen die een overeenkomst sluit(en) met Casa Bohemian Curaçao B.V . met betrekking tot de huur en/of gebruik van de accommodatie en/of andere faciliteit, alsook alle medegebruikers die deel uitmaken van het gezelschap van de huurder die gezamenlijk de accommodatie gebruiken. Onder “verhuurder” wordt verstaan Casa Bohemian Curaçao B.V . (hierna ook te noemen Casa Bohemian), ingeschreven bij de Kamer van Koophandel onder nummer 169172. Het cribnummer van Casa Bohemian Curaçao BV is 102723321.
Reservations
When Casa Bohemian processes the tenant’s reservation, the landlord/landlady will send the tenant a confirmation email containing the payment terms. The tenant must verify all reservation information for accuracy. Any inaccuracies must be reported to the landlord/landlady immediately.
The agreement between the tenant and the landlord is concluded when Casa Bohemian
emails the tenant the reservation confirmation and the payment terms.
The payment terms are as follows: the tenant must deposit 30% of the rent (deposit) into
the landlord’s bank account within 5 (five) days of sending the confirmation email. The
remaining 70% of the total rental amount must be deposited into the landlord’s bank
account no later than 4 (four) weeks before the agreed arrival date at Casa Bohemian. If
you book through Airbnb, booking.com, or VRBO, the rules may diDer. Please consult the
relevant booking site for more information.
If the stay at Casa Bohemian is 30 nights or longer, the deposit is 40% of the rent, which
must be credited to the landlord’s bank account within 5 days of sending the
confirmation email. The remaining 60% of the total rental amount must be credited to
the landlord’s bank account no later than 6 (six) weeks before the agreed arrival date at
Casa Bohemian.
After sending the confirmation email and agreeing to the payment terms, the landlord
will reserve the reserved accommodation for a maximum of 5 (five) days. If the agreed
amount (deposit) is not credited to the landlord’s account within 5 days, the reservation
is cancelled. After this 5-day period, the tenant can no longer derive any rights from the
reservation. The reservation is final once the agreed amount (deposit) has been credited
to the landlord’s account.
Indien huurder, na totstandkoming van de huurovereenkomst, wijzigingen in de overeenkomst
wenst aan te brengen, dan is verhuurder niet verplicht deze wijzigingen te accepteren. In het
geval dat verhuurder uw wijzigingen accepteert, kunnen door verhuurder wijzigingskosten en
andere additionele kosten in rekening worden gebracht.
If the tenant wishes to make changes to the rental agreement after it has been
concluded, the landlord is not obligated to accept these changes. If the landlord/landlady accepts your changes, the landlord/landlady may charge amendment
fees and other additional costs.
The remaining balance must be credited to Casa Bohemian’s bank account no later than
4 weeks, or 6 weeks depending on the length of the stay, before the agreed arrival date. If
the tenant fails to do so and the payment deadline has passed, the reservation will
automatically be cancelled and considered a cancellation. In that case, the tenant will
no longer have any rights under the reservation. The deposit will not be refunded.
Arrival and Departure
The rented accommodation can be occupied on the agreed arrival date between 3:00
PM and 9:00 PM. If, due to unforeseen circumstances (e.g., a late flight arrival or flight
delay), the tenant expects to arrive later than 9:00 PM, the landlord may make an
exception. The tenant must notify the landlord of this in a timely manner.
On the agreed departure date, the accommodation must be vacated by 11:00 AM. The
tenant may use the Casa Bohemian facilities on the day of departure. Late check-out is
possible, if available and requested in advance. There is an additional charge of $50 for
check-outs before 4:00 PM.
If the use of the accommodation and/or other facilities is terminated earlier than the
agreed date, the tenant is not entitled to a refund of (part of) the rental price and/or
costs.
Rules
Smoking is strictly prohibited inside the accommodation.
The tenant must leave the accommodation spotlessly clean. Dishes must be washed,
and garbage must be placed in the outside dumpsters.
If the tenant misbehaves or causes a nuisance, the landlord/landlady reserves the right
to immediately remove the person or persons from the resort without refunding the
rental fee or any portion thereof.
Pets are not permitted.
Other than for the number of people for which the reservation has been confirmed by
the landlord/landlady, it is not permitted to host or allow third parties to stay overnight at
Casa Bohemian without the landlord’s/landlady’s express permission.
The tenant is liable for any damage due to breakage and/or loss and/or damage to
inventory and/or accommodation. Any damage must be reported immediately to the
landlord/landlady by the tenant and compensated immediately on-site.
Cancellation
If a reservation is canceled by the tenant, the tenant is liable for cancellation fees. These
fees are 30% of the total cost for cancellations up to 8 weeks before the agreed arrival date, and the total agreed rental price for cancellations on or after 4 weeks before the
agreed arrival date, or later.
If the stay at Casa Bohemian is 21 nights or longer, the fees are 40% of the total cost for
cancellations up to 10 weeks before the agreed arrival date, and the total agreed rental
price for cancellations on or after 6 weeks before the agreed arrival date, or later.
If the tenant fails to arrive within 24 hours of the agreed arrival date without further
notice, this will be considered a cancellation. In this case, no refund of the rental fee or
any portion thereof will be made.
Force Majeure and Changes
If Casa Bohemian is (temporarily) unable to perform the agreement in whole or in part
due to force majeure, the landlord/landlady will submit a proposed change (for a
diDerent period, diDerent accommodation, in the form of a voucher)
within 25 days after the tenant becomes aware of the inability to perform the agreement. Force majeure on
the landlord’s/landlady’s part refers to circumstances beyond the landlord’s/landlady’s
control, including the threat of war, strikes, blockades, fire, floods, natural disasters,
pandemics, and/or other disruptions or events, if the landlord/landlady is prevented
from performing the agreement in whole or in part, temporarily or permanently.
The tenant has the right to reject the proposed change. If you reject the proposed
change, you must notify the landlord/landlady within 10 days of submitting the proposed
change. In that case, the landlord/landlady has the right to terminate the agreement with
immediate eDect. In the event of force majeure, the landlord/landlady will refund any
monies paid to the tenant, minus an administration fee of $100.
Liability
The landlord/landlady accepts no liability for theft, loss, or damage of or to property or
persons, of any nature whatsoever, during or as a result of the stay at Casa Bohemian
and/or the rental/use of the accommodation/other facilities.
Liability for damages consisting of loss of enjoyment of the trip or business or other
consequential damages is excluded under all circumstances. The landlord is in no way
liable for damages for which a claim for compensation exists under travel and/or
cancellation insurance or any other insurance. The landlord is not liable for disruptions
to the service or defects in services provided by third parties.
The tenant is jointly and severally liable for all loss and/or damage to the rented
accommodation and/or the tenant’s property, which occurs during the tenant’s use
thereof, regardless of whether this is the result of the actions or omissions of the tenant
or of third parties present at Casa Bohemian with the tenant’s permission. In case of
improper use or failure to leave the accommodation or inventory in a proper condition,
including but not limited to excessive soiling, additional costs will be charged, which the
tenant is obliged to pay immediately.
Applicable law
The agreement between the tenant and Casa Bohemian is governed exclusively by
Dutch/Curaçao law.

The landlord/landlady accepts no liability for translation, printing, or typographical errors.
